I am foreign property investor assuming the property is still in my name at my death would my will be recognised in South Africa.?

Foreign Investor: If I proceed to purchase a property in Simon’s Town then it is unlikely that I would be there at the time of purchase in which case I will need an attorney with a special Power of Attorney to sign the documents on my behalf. I understand that you may be in a position to handle that issue.

Foreign Investor: What is the position on the transfer of funds into and more important (on my death) out of South Africa?

Foreign Investor: some improvements could be done on the property then I would consider applying for a local mortgage of approx 25% of the purchase price. Please confirm if you would be able to arrange that and if so what would be the actual repayments be for a 15 year term, and an interest only mortgage. Not sure if the latter is available in South Africa.

Foreing Investor: another option which I would consider (maybe instead of a mortgage), would be to invite one or two friends (UK and USA) to invest in the property with me. Please advise if that would a legal problem.
